Legal documents
Terms of use and sale
These terms set the rules for using SmartCom360 and subscribing to its plans: free trial, prices, payment, renewal, AI credits and what happens to your data. They go together with the legal notice and the privacy policy.
1. Purpose and acceptance
These general terms of use and sale apply to the company that opens a SmartCom360 account (“you”) and to everyone who uses the service on its behalf.
SmartCom360 is published by David Rene METOMO and Jean Pierre MAMBINGO (Cameroon), referred to below as “we”.
By creating an account or paying for a plan, you accept these terms.
2. The service
SmartCom360 is online business management software: point of sale, stock, sales, customers, after-sales service, deliveries, restaurant management, online catalogue, WhatsApp agent and AI assistant.
The modules available depend on the plan subscribed to and on the company’s business sector.
3. Account and access
- Sign-up is done online in three steps: your account, your company, then a verification code received by SMS.
- The information given at sign-up must be accurate.
- The company administrator creates the accounts of their staff. They are answerable for these accounts and for how they are used.
- Access is reserved for people to whom the administrator has given an account. Everyone keeps their credentials to themselves.
- Report any suspicious access to contact.smartcom.app@gmail.com.
4. Free trial
- A new company can try SmartCom360 for free, without a bank card.
- The length of the trial is set by SmartCom360 and shown at sign-up.
- During the trial, the number of users is limited.
- To keep using SmartCom360 after the trial, subscribe to a plan.
5. Plans and prices
Each plan states:
- Its price, in CFA francs.
- Its duration: monthly, several months, yearly or lifetime (one-off payment).
- The modules included.
- The number of users.
The terms that apply are those shown on the website and in the application when you subscribe.
Plans and prices may change. A change does not apply to a period already paid for.
6. Payment
Payment is made from the application, by one of these methods:
- Orange Money or MTN Mobile Money, through CamPay.
- Bank card, through Flutterwave or Stripe.
SmartCom360 does not keep card numbers: they are handled by the payment providers.
7. Renewal and expiry
- The subscription is renewed by a payment from the company’s administrator or manager.
- Reminders are sent from fourteen days before the expiry date.
- After the expiry date, a grace period may keep access open. Beyond it, access is blocked until payment.
- Renewing after the expiry date may include a reactivation fee. Its amount is shown before payment.
8. AI credits
The AI assistant and the WhatsApp agent use credits.
- Each plan may include a monthly allowance of credits. It expires at the end of the month.
- Credits bought in packs stay on the balance until they are used.
- The company can turn on automatic credit top-up: a pack is bought when the balance falls below a threshold, at most once a day. It can turn it off at any time.
9. Your data
- The data you record in SmartCom360 remains yours. You only allow us to host and process it in order to provide the service.
- The administrator can export it at any time, in Excel format, from Settings → Data.
- Each company remains responsible for the information it records and for its relationship with its own customers, including telling them how their data is used.
- What we do with your data, with which providers, and how to exercise your rights: all of it is described in the privacy policy.
10. Rules of use
You may not use the service for unlawful purposes, try to reach another company’s data or disrupt the service.
An account that breaks these rules may be suspended.
11. Suspension, deletion and end of subscription
- A suspended company may then be permanently deleted by SmartCom360, all its data included. Payments already received remain in SmartCom360’s accounts.
- The administrator can also ask for the company’s account to be closed and its data deleted by writing to contact.smartcom.app@gmail.com. We delete it, subject to what the law requires us to keep.
- In every case, export your data first: a permanent deletion cannot be undone.
12. Availability
We do our best to keep SmartCom360 available at all times, but cannot guarantee it: maintenance, a provider outage or a network failure may interrupt it. We recommend exporting your data regularly from Settings → Data.
13. Intellectual property
The software, its name, logo, interface and documentation belong to their publishers. They may not be copied, extracted or reused without permission.
14. Liability
SmartCom360 is a management aid. Business, tax or accounting decisions made from what it displays are the user’s own. Answers from the AI assistant are given for guidance and must be checked before being acted on.
We are not liable for indirect losses (lost profit, lost customers). If a malfunction attributable to us causes you harm, our liability is limited to the amounts you paid for your subscription over the last twelve months, unless the law provides otherwise.
15. Changes to these terms
We update these terms when the service changes; the date is shown at the top of the page. An important change is announced in the application or by email.
16. Governing law and contact
These terms are governed by the law of Cameroon. If you disagree with us, write to us first: we will look for an amicable solution. Failing that, the dispute will be brought before the competent courts of Cameroon.
